ICC YAF: Virtual Hearings and Due Process Paranoia

This in-person event is part of Dubai Arbitration Week that follows the event ICC Emergency Arbitrator Procedure: The Lay of the Land.

The COVID-19 pandemic has prompted a significant increase of digitalisation in international arbitration, particularly the reliance on virtual hearings. With no clear end in sight of pandemic-related measures, virtual hearings continue to offer a practical alternative to physical hearings. However, virtual hearings have been at the centre of heated debates and challenges over potential violations of due process. Separately, many arbitration practitioners advocate in favour of virtual hearings as an efficient and cost-effective solution regardless of travel and sanitary restrictions.
